Workers' compensation claim denied - now what?

We get the question all the time - "If I was hurt at work, how can they deny my claim?"  The answer is that the insurance company can choose to deny your claim for any reason, or no reason at all.  Often, we see insurance companies quickly deny a claim in the hopes that an injured worker who is unfamiliar with the process won't know that a denial is not the end of the road for their claim.  For us, it's often where a case begins. 

 

Workers' Compensation is supposed to provide compensation for all workers who are injured by an accident in the course and scope of their employment.  However, insurance companies can and will exploit every possible loophole to deny a claim.  For example, the insurance company might admit that you are injured, but claim that your injuries were not caused by an "accident," and that you were doing your "usual job in the usual way" when the injury occurred.  They may also simply deny that you experienced any injury at all. 

 

If your claim has been denied by the insurance company, that does not mean you are not entitled to benefits.  The Industrial Commission, which is the "court" that handles workers' compensation cases, decides whether you have a good claim - NOT the insurance company.  

When your claim is denied you have a great deal of options, but those options typically involve filings and proceedings before the Industrial Commission, requesting documents and medical records through the discovery process, and possibly depositions or a hearing.  You can, and should fight for your benefits when your claim has been wrongfully denied - but you shouldn't do it alone.  Our dedicated workers' compensation team fights for the rights of injured workers every day, and knows how to get results.
